AZ AG Tom Horne’s strong message to Feds: Stop sending Illegals to AZ

AG cites federal statutes, potential legal action if dumping of illegals continues

Arizona Attorney General Tom Horne today formally demanded that the U.S. Department of Homeland Security (DHS) immediately cease and desist the transportation and abandonment of illegal aliens from other states into Arizona.

Citing federal statutes – 8 U.S.C. § 1103(a)(5) and 8 U.S.C. § 1324(a)(1)(A)(ii) —  the Department of Homeland Security has been told to stop abandoning foreign nationals in Arizona.

In a statement released today, Horne said, “In the past two weeks, the Department of Homeland Security has transported, and continues to transport, a significant number of illegal immigrants from other states into Arizona.

Men, women and children left at bus terminals in temperatures exceeding 100 degrees with nothing more than instructions to report to the nearest ICE office within 15 days, posing significant health and safety risks both for the people being abandoned and the communities in which they are being stranded, is not acceptable.”

He noted, “Not only were these inadvisable and irresponsible actions done without notifying Arizona officials, but DHS has yet to explain why it is apprehending aliens in Texas, moving them some 1200 miles and simply releasing them in our state. There does not appear to be any lawful authority for such actions, and I am demanding it immediately stops. In the meantime, my office is aggressively looking into what legal remedies are available to allow for a federal lawsuit.”

This letter, the formal request for immediate agency action, was sent to Secretary of Homeland Security Jeh Johnson earlier today (June 12, 2014). In it, Attorney General Horne requests that the DHS furnish the following information as soon as possible:

1. The number of aliens transported to Arizona from Texas and left at bus stations since May 1, 2014;

2. The steps DHS took to ensure that none of these aliens were in need of medical treatment and that all of them were inoculated against communicable diseases;

3. The steps DHS took to ensure that none of these aliens were convicted criminals or engaged in smuggling or human trafficking at the time of their apprehension;

4. The steps DHS took to ensure that these aliens had sufficient financial and other means to avoid exploitation or the need for intervention by Arizona public officials in order to protect their safety and welfare; and

5. The steps DHS is taking to monitor their whereabouts and/or ensure that they will report to ICE offices for processing as instructed before they were released.

Given the Democrat-aiding amnesty scheming by the Obama administration, we might grow old waiting for an appropriate response to Attorney General Horne‘s reasonable request.

    We need our County Sheriff’s to stop them at the border and turn them back. Everyone always talks about how much authority they have well lets see them exercise some of it and also have Gov. Brewer do more than talk, she can and should use the authority she has to put a stop to this or like most other things just more talk.

      Since you’re running for congress, you’d do well to brush up on the state’s boundaries. The individual county sheriffs only have authority in their own counties, where they each were elected. The Coconino County Sheriff, whose border abuts the northern part of the state (nowhere near the border), has no authority (nor should he!) in Pima County which abuts the Mexican border.

      In the northern part of AZ, Mohave County abuts California, Nevada and Utah. Coconino and Navajo Counties touch Utah and Apache nestles up against Utah and New Mexico with a tip abutting Colorado.

      Of Arizona’s 15 counties, only Yuma, Pima, Santa Cruz and Cochise are border counties.

    Doug McDucey is running ads on Limbaugh’s show talking about enforcing the law and protecting the border. Helping Veterans as well.

    Why is he touting his endorsement from open borders clown Scott Walker? Scott Walker endorsed Paul Ryan’s cuts to veterans COLA. So did Lindsey Graham and then Lindsey Graham backflipped because of the outrage.

    Scott McWalker: “You hear some people talk about border security and a wall and all that– to me, I don’t know that we need any of that.”

    He seems to think anyone who wants to undermine wages should be given a work permit as long as they promise to behave.

      yes, McDucey is McCain, through and through ….and Mark McBrnovitch is hiding behind Bill McMontgomery’s skirt. We’ve got a bunch of political nothings posing as somethings as they rip Horne…a man who is actually doing the tough job and doing it well. At a Horne fundraiser, Sheriff Arpaio defined this correctly, saying It all boils down to illegal immigration. There are the defenders of the invasion and those who stand up against it. Horne is standing against it and the rest are standing with McCain.

      Don’t forget how McMontgomery repaid Arpaio for his support in hosting his fundraising events and bringing in the donors. McMontgomery ridiculed Arpaio, saying talking with him was like visiting an Alzheimer’s unit. The best part of McMontgomery’s incredible ingratitude was the way it was exposed. Montgomery was bootlicking like the hypocrite dirt bag he is to another dirt bag Don Stapley, when he was sucking up for an appointment to the county attorney’s job. Stapley actually tape recorded McMontgomery and his vicious spew recording ended up in the New Times.

      After listening to this, no on can accuse McMontgomery of being a class act, yet this is the man McBrnovitch hails as his endorser-in-chief.

    Think what one may about Twiiter, my comment to have Eric Holder Impeached was sent around the world a few times. The AG stepping up and Brewer’s letter to Obama has also been sent out on the airwaves. Much of America doesn’t realize these Illegals were dumped, and into the center of our State. (Most think its all at the Border) Obama is involved in what I call “State breaking” – he’s trying to break the back of AZ, and find any excuse to start an all out war. This isn’t conspiracy. Its reality. Democrats out there refuse to believe its “actually happening”.Its not on the news at all on the East Coast. At All. Its a sad place, this America, except for the awake, alive patriots.       If you watch Andrew Thomas’ speech on his campaign site, he goes into detail at how the pro-invasion forces have chipped away at every statutory effort Arizona has made in defense of the invasion, and have put the state back where it was ten years ago. The dumping of aliens in the heart of Arizona is just another tactic by Obama and his junk yard dog Jeh Johnson to add an exclamation point. We are at war, and the pink slime is winning.

    Tom Horne is right. But the real culprits are our federal representatives in congress who should have placed troops on the border 20 years ago.

    The damage now is great. 15 million law breakers by conservative estimates are here, competing for jobs, housing, education and social services with all of us.

    Vetted non-performers like John McCain should be leading on this issue, but either cannot or will not. He’s probably humming Silent Night somewhere in Washington waiting for his next media interview.

    Sheriff Joe (Arpaio) tried to lend some assistance. But the same folks who complained about that got us laws now make it illegal to ask for identification at polling places.

    It’s a lonely road trying to get the feds to do their job. Thankless and unrewarding too.
