9th Circuit Court of Appeals upholds AZ ballot harvesting law

Within short order after the Arizona legislature passed HB 2023 halting the practice of “ballot harvesting,” Gov. Doug Ducey signed it into law. Like clockwork, challenges followed  It eventually made its way to the Ninth U.S. Circuit Court of Appeals.

It was in that reliably left-leaning court that a divided three judge panel on Friday surprisingly voted to uphold the Arizona law, with one judge dissenting.

 Referencing  Arizona’s law, Judge Sandra Ikuta wrote in the 58-page opinion, “Laws like this can strengthen public confidence in the integrity of the electoral process which encourages citizen participation in the democratic process.”

She’s exactly right.

 Chief Judge Sidney Thomas’ long-winded dissent, beginning after the majority affirmation on page 58, is filled with the expected leftwing blather claiming Arizona’s law disenfranchises multitudes of voters, among them minorities, the poor, and the infirm. According to his reasoning, these citizens which he has singled out, have no right to expect an elective system based on ballot integrity.

      It would seem so, azgary, but I remain suspicious.

      I well remember when a three judge panel of the Ninth Circuit with retired U.S. Supreme Court Justice and Arizonan Sandra O’Connor sitting with the panel, ruled that Arizona could not require those registering to vote to provide proof of citizenship. Her bizarre actions opened the door to voter fraud, as they arrogantly overturned the 2004 voter approved provisions of Prop 200.

      In that 2010 case Circuit Judge Sandra Ikuta joined with O’Connor declaring Prop. 200 created an “additional hurdle“ and “state-imposed obstacles” to registration. Is it possible Berkeley educated Judge Ikuta has gotten wiser in the intervening years? Clearly something’s going on.

      Ikuta’s 2006 judicial confirmation vote can be seen here, with then-Sen. Jon Kyl voting for her and candidate John McCain prudently not voting.

    Tell me to shut the Hell up if you like, but this decision is 100 days too late. John McCain won his Primary with early, mail-in ballots and his campaign hired hundreds of “interns” to engage in so-called ballot harvesting. He knew he’d won before the actual count and our 30% turn out couldn’t cover his interns’ canvassing and collecting.
    Recall his victory was announced less than an hour after our polls closed on August 30th.
    At least Flake will have to win the old fashioned way.

    The NYPD and FDNY have been put on notice that they must be involved in this sideshow. And they are furious over being ordered to participate in this.

      You’re far from alone in being a first time Dem voter. McCain has driven many of us to do the previously unthinkable.. As a still standing precinct committeeman not taken down by the McCain Mafia as has happened to countless others, I go door to door delivering campaign materials and talking to the voters in my area. I’ve worked in this elected/volunteer capacity for years and never before encountered so many Republicans who are vocal about their party switch when it comes to the man they refer to as a disgusting, despicable, rotten, miserable liar—-take your pick. I’ve heard those terms and much worse to describe him. If my contacts are any indicator, McCain will discover a downturn in his support. I just hope it’s enough to toss his decrepit ass out of the senate

    Someone posted yesterday on SRAZ that he/she received a robocall from Matt Salmon endorsing McCain.

    Matt Salmon has been a real disappointment. McCain’s no conservative like Salmon professes to be and he’s got nothing to lose retiring from Congress. You’d think he’d sit this one out.
